15. The bidding supplier believes that the qualifications of other suppliers are in doubt, but there is no evidence, can you question it?

Answer: The purchaser or purchasing agency is the object of the questioning, and other suppliers are the relevant parties of the questioning. The "questioning" of bidding suppliers on the qualifications of participating suppliers is actually a questioning of the qualification review or evaluation process of the purchaser or procurement agency. Within the statutory time limit, the challenged supplier can be raised in writing to the purchaser and procurement agency.

Although the challenged supplier did not provide evidence, it can only be raised within the statutory period. The purchaser or procurement agency cannot refuse to accept it. It should actively collect evidence based on the content of the supplier's challenge, query the public information on the government website, or organize the original bid evaluation committee to assist Answer the question. If the verification is true, the challenge shall be answered.

What needs to be pointed out is that the supplier should rely on the necessary facts and legal basis as much as possible when questioning, not just guessing, otherwise the questioning request is very likely to be rejected in the reply.

Legal basis

"Measures for Government Procurement Questions and Complaints" (Order No. 94 of the Ministry of Finance) Article 10 If a supplier believes that the procurement documents, procurement process, bid winning or transaction result has harmed his rights and interests, he may know or should know that his rights and interests have been harmed. Within 7 working days from the date of registration, the purchaser and the procurement agency shall be challenged in writing. Purchasing documents may require suppliers to raise questions about the same link of the procurement procedure at one time during the statutory questioning period.
